How to Handle a Request for Medical Leave: For Employers

When an employee asks for time off for a medical reason, there are many federal and state laws that may be triggered. It is important for businesses to be aware of their obligations to employees and options regarding employee leave.
Here are a few laws that may come into play when an employee needs time off from work for medical reasons:
 
1. Family Medical Leave Act (FMLA) - up to 12 weeks of unpaid leave for certain situations;
includes care for themselves and their spouse, child or parent;
 
2. Americans with Disability Act (ADA)- includes mental health issues, such as anxiety and depression;
 
3. Workers Comp - for workplace injuries;
 
4. Company Policy - what are your internal policies;
 
5. State law - there are different laws depending on what state your employee performs work.
